These terms are an agreement between you and [LEGAL ENTITY NAME] ([ABN / ACN OR COMPANY NUMBER]) (“Sky BizBook”, “we”, “us”). They cover your use of the Sky BizBook apps for web, Android and iOS and the website at skybizbook.com (together, the “Service”). Please read them with our Privacy Policy, which explains how we handle personal information.

By creating an account or using the Service, you agree to these terms. If you use Sky BizBook for a business, you agree on behalf of that business and confirm you’re allowed to.

1. Who can use Sky BizBook

You must be at least 18 and able to enter into a binding contract. Sky BizBook is made for businesses, such as sole traders, contractors, freelancers and small companies in Australia, Canada and the United States. It isn’t designed for personal or household use.

2. The Service

Sky BizBook helps you run a small business. It covers customers, quotes, jobs, invoices, bills and expenses, contracts, reports, booking pages and calendars, website forms, point of sale and stock, team job assignments and an AI assistant. Some features depend on your plan.

We keep improving the Service, so features may change. If we remove something important from a paid plan, we’ll tell you beforehand where we reasonably can.

3. Your account

  • Give us accurate information and keep it up to date.
  • Keep your login details secure. You’re responsible for what happens under your account, including anything done by team members you invite.
  • You decide what your team members can see and do, and you’re responsible for them following these terms.
  • If you think someone has used your account without permission, tell us straight away at [CONTACT EMAIL].

4. Plans, subscriptions and billing

  • Plans. There’s a Free plan and paid plans (currently Lite, Pro and Team) with different monthly limits, for example on invoices, jobs and AI use. Current prices and limits are shown in the app and on our website.
  • Automatic renewal. Paid plans are subscriptions. They renew automatically at the end of each billing period until you cancel.
  • Where you pay. You can subscribe through the Apple App Store, Google Play or our web checkout, which our subscription partner RevenueCat runs for us. The store or checkout you use takes the payment, and its terms apply as well as these.
  • Cancelling. Cancel in your App Store or Google Play subscription settings, or in the web billing portal if you subscribed on the web. For app store subscriptions, cancel at least 24 hours before the renewal date to avoid the next charge. Your plan stays active until the end of the period you’ve paid for.
  • Free trials. If we offer a free trial, your paid subscription starts automatically when the trial ends unless you cancel before then.
  • Refunds. Apple and Google handle refunds for purchases made through their stores, under their own policies. For web subscriptions, we don’t refund part-used billing periods unless the law requires us to. This doesn’t limit your rights under consumer law (see section 14).
  • Price changes. We’ll tell you at least 30 days before a price change applies to your subscription. App stores may also ask you to agree to the new price.
  • Taxes. Depending on where you are and how you subscribe, prices may include or have added GST, HST, sales tax or similar taxes.
  • Changing plans. If you move to a lower plan or a paid plan ends, you keep your data, but the lower plan’s limits apply. For example, you may not be able to create more invoices that month once you reach the limit.

5. Getting paid through Stripe

  • Online payments, such as Pay now links on invoices and paid bookings, are provided by Stripe. To use them you connect your own Stripe account and accept Stripe’s terms, including the Stripe Connected Account Agreement.
  • Payments go straight into your Stripe account. We don’t receive, hold or control your money, and we aren’t a party to the sale between you and your customer.
  • Stripe charges its own processing fees. Sky BizBook doesn’t currently add a fee to payments. If we ever introduce one, we’ll tell you beforehand.
  • You’re responsible for what you sell and for your prices, cancellation and refund policies, refunds, disputes and chargebacks. If you turn on automatic refunds for paid bookings, we ask Stripe to make those refunds based on your settings, but the outcome remains your responsibility.
  • Stripe may limit, suspend or close your Stripe account under its own terms. We have no control over that.

6. Your content and your customers’ information

  • You own the information you put into Sky BizBook (“your content”), including customer details, invoices, job records, photos and files.
  • You allow us to host, store, copy, process and display your content only as needed to run, secure and improve the Service and to support you. This permission ends when your content is deleted, apart from backup copies kept for a limited time.
  • When you store information about your customers, staff or anyone else, you’re responsible for having the right to do so under the privacy laws that apply to you. You’re also responsible for telling them how you use it, for example by linking to your own privacy notice from your booking pages and forms.
  • We handle your customers’ information on your behalf, as described in our Privacy Policy. We don’t sell it and we don’t use it to market to your customers.
  • Anyone who has a shared link can open it. This includes job pages, booking pages, forms and invoice pay links, so only share them with the people who are meant to see them.
  • Keep your own copies of important records. You can export reports from the app, but Sky BizBook doesn’t replace the records tax law requires you to keep.

7. Acceptable use

When you use Sky BizBook, you must not:

  • break the law, or use the Service for fraud, scams or selling illegal goods or services;
  • send spam or messages people haven’t agreed to get, or use our email, booking or form tools to harass anyone;
  • upload malware, or content that infringes anyone’s rights or is defamatory, obscene or hateful;
  • store full payment card numbers, government ID numbers, health records or other sensitive information the Service isn’t designed for (card payments must go through Stripe);
  • get around plan limits or security measures, or try to access other people’s accounts or data;
  • copy, reverse engineer, scrape or resell the Service, or overload it with automated requests;
  • use the Service to build a competing product.

We may remove content or limit accounts that break these rules.

8. AI features

  • Sky BizBook’s AI features include the Sky assistant, drafting invoice and quote emails, drafting contracts and reading bills and receipts from photos. Google’s Gemini models power them.
  • AI can be wrong or incomplete. Check what it produces before you rely on it or send it to anyone. It isn’t legal, tax, accounting or financial advice.
  • AI-drafted contracts are only a starting point. Have important contracts reviewed by a lawyer.
  • To answer a request, we send it to Google along with the business information it needs. Our Privacy Policy explains how.
  • How much you can use AI depends on your plan.

9. Tax, invoices and your business obligations

  • You’re responsible for what your quotes, invoices, receipts and contracts say. This includes tax amounts, tax registration numbers and the invoice rules where you trade, such as tax invoice rules in Australia, GST/HST in Canada and sales tax in the United States.
  • Our tax calculations and reports are tools to help you. They aren’t professional advice, so check with your accountant.
  • You’re responsible for following the laws that apply to your business. These include consumer, privacy, employment and anti-spam laws (such as Australia’s Spam Act 2003, Canada’s Anti-Spam Legislation and the US CAN-SPAM Act).

10. Third-party services

The Service relies on and links to services run by other companies. They include Stripe, Apple, Google, RevenueCat and the others listed in our Privacy Policy. Their own terms and privacy policies apply when you use them, and we aren’t responsible for how they operate. We may change the providers we use.

11. Our intellectual property

We and our licensors own the Service, including the software, design, templates, and the Sky BizBook name and logo. While your account is in good standing, we give you a non-exclusive, non-transferable right to use the Service for your business. If you send us feedback or ideas, we may use them without owing you anything.

12. Availability and support

We work to keep Sky BizBook available and reliable, but we can’t promise it will always be uninterrupted or error-free. Sometimes we need downtime for maintenance, and we try to keep the disruption small. For help, email us at [CONTACT EMAIL].

13. Closing your account, suspension and termination

  • You can stop using Sky BizBook at any time. To close your account and have your data deleted, email us at [CONTACT EMAIL].
  • Closing your account doesn’t cancel an App Store or Google Play subscription. Cancel that in your store account as well.
  • We may suspend or close your account in some cases. These are a serious or repeated breach of these terms, unpaid fees, a legal requirement, or a need to protect the Service, other users or the public. Where it’s reasonable, we’ll warn you first and give you a chance to fix the problem and export your data.
  • If we decide to stop offering Sky BizBook, we’ll give you at least 60 days’ notice. We’ll also refund any fees you prepaid to us for the time after it ends.
  • After an account is closed, we delete its content as described in our Privacy Policy. Some parts of these terms continue to apply after closure, such as fees owed, intellectual property, disclaimers, liability and disputes.

14. Your rights under consumer law

Nothing in these terms excludes, restricts or changes any right, remedy or guarantee that the law gives you and doesn’t allow to be excluded. That includes rights under the Australian Consumer Law, Canadian provincial consumer protection laws (such as Quebec’s Consumer Protection Act) and US state laws.

Sometimes the law lets us limit our liability for failing to meet a consumer guarantee, for services not ordinarily acquired for personal, domestic or household use. In that case, our liability is limited to supplying the services again or paying the cost of having them supplied again.

15. Disclaimers

Except as set out in section 14, and as far as the law allows, the Service is provided “as is” and “as available”. We make no other promises about it, including that it will meet all your needs or be free of errors, or that AI output, tax calculations or reports will be accurate.

16. Limitation of liability

As far as the law allows:

  • we aren’t liable for indirect or consequential loss, or for lost profits, revenue, business, data or goodwill, however it arises;
  • we aren’t liable for what Stripe, app stores or other third parties do or fail to do, or for disputes between you and your customers;
  • our total liability for all claims about these terms or the Service is limited to the greater of what you paid us in the 12 months before the claim arose, or AUD $100 (or the equivalent in your currency).

These limits don’t apply to liability the law doesn’t allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence.

17. Indemnity

As far as the law allows, you agree to cover our losses and reasonable costs, including legal costs, from claims by others, including your customers. This applies to claims about your content, your products or services, your dealings with your customers, or your breach of these terms or the law. It doesn’t apply to the extent we caused the loss.

18. Changes to these terms

We may update these terms as the Service and the law change. We’ll post the new version here with a new effective date. For significant changes, we’ll tell you by email or in the app at least 30 days before they take effect. If you don’t agree, you can stop using the Service and close your account before then. If you keep using it after the changes take effect, you accept the updated terms.

19. Governing law and disputes

  • These terms are governed by the laws of [GOVERNING LAW: STATE / PROVINCE AND COUNTRY].
  • If you have a dispute with us, please contact us first at [CONTACT EMAIL]. We’ll try to sort it out with you informally within 30 days.
  • If that doesn’t work, either of us may take the dispute to the courts of [GOVERNING LAW: STATE / PROVINCE AND COUNTRY]. If the law where you live lets you bring the claim in your local courts, you can do that instead.

20. Apple App Store and Google Play

If you downloaded Sky BizBook from the Apple App Store:

  • these terms are between you and us, not Apple, and Apple isn’t responsible for the app or its content;
  • you may use the app on Apple-branded devices you own or control, as the App Store’s Usage Rules allow;
  • Apple has no obligation to provide maintenance or support for the app;
  • if the app fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for the app (if any). As far as the law allows, Apple has no other warranty obligation for the app;
  • we, not Apple, are responsible for any claims about the app. These include product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims;
  • if someone claims the app infringes their intellectual property rights, we, not Apple, are responsible for investigating and dealing with that claim;
  • you confirm you aren’t located in a country subject to a US Government embargo, or designated by the US Government as a “terrorist supporting” country. You also confirm you aren’t on any US Government list of prohibited or restricted parties;
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded Sky BizBook from Google Play, the Google Play Terms of Service also apply to your download and purchases.

21. General

  • These terms and our Privacy Policy are the whole agreement between you and us about the Service.
  • If any part of these terms can’t be enforced, the rest still applies.
  • If we don’t enforce a right straight away, we haven’t given it up.
  • You can’t transfer your rights under these terms without our written consent. We may transfer ours to a business that takes over Sky BizBook, and we’ll tell you if that happens.
  • We aren’t responsible for delays or failures caused by events outside our reasonable control.
